Terms of Service

These Terms of Service ("Terms") govern access to and use of the PrimeVistara Cloud platform, website and APIs. By creating an account or using the service you agree to these Terms.

1. Accounts

You must provide accurate registration details, keep credentials secure, and are responsible for activity under your account. You must be authorised to bind your organisation.

2. Acceptable use

  • No unlawful, infringing, or abusive activity, malware distribution, or network attacks.
  • No attempts to disrupt, reverse-engineer, or gain unauthorised access to the platform or other tenants.
  • You are responsible for the legality of customer content you store or process.

3. Pricing & billing

Charges follow the published unit pricing, metered and invoiced in INR exclusive of GST. Compute is metered hourly and aggregated to the monthly rate; storage and IPs are billed monthly. Fees are due per invoice; non-payment may lead to suspension.

4. Service levels

We target a 99.99% instance SLA with per-host redundancy and live migration during maintenance. Specific SLA credits, if any, are set out in your order or service agreement.

5. Customer content & data

You retain all rights to your content. We process it only to operate the service or as you instruct, within India. See the Privacy Policy.

6. Suspension & termination

We may suspend or terminate for material breach, non-payment, or legal requirement. You may close your account at any time; you remain liable for accrued charges. On termination you may export data within a reasonable window before deletion, subject to legal holds.

7. Warranties & liability

The service is provided on a commercially reasonable basis. To the extent permitted by law, liability is limited as set out in your service agreement. You are responsible for maintaining your own backups and disaster-recovery posture.

8. Governing law

These Terms are governed by the laws of India, with exclusive jurisdiction of the courts at the seat specified in your order, and subject to the Information Technology Act, 2000 and the DPDP Act, 2023 where applicable.

9. Changes

We may update these Terms; material changes will be notified to account holders and posted here with a revised date.
